EU questions Binance over continued operations despite wind-down order, FT reports

币安 earlier this year had its application for a license under the EU’s new Markets in Crypto-Assets (MiCA) regime rejected, causing it to lose permission to offer services to European Union clients. Under MiCA, crypto firms were required to obtain a license by the end of June to continue operating across the bloc; without such a license, Binance would not be qualified to operate in the EU from July.
EU officials are now questioning Binance’s reliance on the“reverse solicitation”legal exemption, which allows firms based outside the EU to provide financial services to bloc customers only if those users initiate the relationship entirely on their own initiative. The exemption is being examined to see whether Binance is using it to continue serving European customers despite the wind‑down order.
The European Securities and Markets Authority (ESMA) told the Financial Times that the reverse solicitation exemption should be understood as very narrowly framed, an exception, and not be used to circumvent MiCA requirements. Some national regulators have requested information from Binance and warned they could take enforcement action, including imposing fines, if the company’s response is unsatisfactory.
A Binance spokesperson told Reuters that the company complies with applicable regulatory requirements in the jurisdictions where it operates and is actively working toward becoming MiCA‑authorised. ESMA declined to comment on the matter.
